Emissions and Regulatory Compliance Notice
Last updated October 18, 2026
Effective date: August 8, 2026
MotoTunePro is a diagnostic and user-directed calibration tool. It is not permission to tamper with emissions controls. Federal, state, and local laws may prohibit removing, disabling, bypassing, or rendering inoperative an emissions-control or required onboard-diagnostic function. Those laws may also prohibit manufacturing, selling, advertising, or installing software, tunes, or devices intended for that result.
“Off-road use only,” “race use only,” “competition use,” a checkbox, or a user waiver does not automatically make a modification lawful.
1. Permitted use
Use MotoTunePro only to diagnose, maintain, repair, restore a vehicle to a lawful certified or original configuration, or apply a modification supported by the approvals and documentation required for the exact motorcycle and jurisdiction. Do not use MotoTunePro to defeat oxygen-sensor strategies, catalyst protection, evaporative controls, required onboard diagnostics, or another emissions-related element.
You are responsible for confirming compliance before modifying, registering, selling, or operating a motorcycle. MotoTunePro USA LLC remains responsible for its own legal duties; this notice does not waive government enforcement or non-waivable rights.
2. Federal Clean Air Act
Clean Air Act Section 203(a)(3), 42 U.S.C. § 7522(a)(3), generally prohibits knowingly removing or rendering inoperative an emissions-control device or element of design after sale. It also generally prohibits manufacturing, selling, offering to sell, or installing a part or component whose principal effect is to bypass, defeat, or render such a device or element inoperative when the person knows or should know it is being offered or used for that purpose. Software and calibrations can fall within defeat-device enforcement.
EPA’s Tampering Policy describes circumstances in which the agency generally exercises enforcement discretion when documented evidence provides a reasonable basis to conclude that conduct does not adversely affect emissions. That policy is nonbinding, does not change the statute, and does not prevent investigation or enforcement in a particular case.
3. Competition, California, and other jurisdictions
Do not assume that labeling or converting a certified highway motorcycle for competition creates a federal exemption. California Vehicle Code section 27156 and related requirements may prohibit emissions-related add-on or modified parts unless a valid exemption applies. CARB identifies ECM programmers and ECM signal modifications as a category that may require an Executive Order. Any approval must cover the exact product, vehicle, model year, and configuration.
Other jurisdictions may impose separate anti-tampering, inspection, noise, road-use, consumer-protection, or aftermarket certification requirements. Legality in one location does not establish legality elsewhere.
4. Before any calibration write
- Identify the exact motorcycle, model year, ECM, current calibration, emissions equipment, and jurisdiction.
- Preserve a restorable backup of the current calibration.
- Determine whether the change restores an original/certified configuration or has a documented lawful basis, certification, or exemption.
- Verify any approval number against the exact vehicle and configuration and retain the documentation.
- Decline the write if it would disable, bypass, mask, or render inoperative an emissions-control or required diagnostic function.
- Comply with inspection, registration, road-use, sale, and disclosure requirements.
A technical validation, checksum, backup, or read-back result does not prove emissions compliance.
5. MotoTunePro boundaries
MotoTune Intelligence may analyze evidence and propose a calibration change, but it cannot determine legal compliance, grant regulatory approval, or autonomously write an ECM. Every write is user-directed and remains subject to identity, backup, voltage, compatibility, checksum, confirmation, read-back, recovery, and power-cycle gates.
MotoTunePro may restrict or remove a feature, tune, file, instruction, or use reasonably believed unsafe or unlawful. Support will not advise users how to defeat emissions controls or evade inspection.
This notice does not:
- legalize prohibited conduct;
- make MotoTunePro an EPA- or CARB-certified product;
- eliminate MotoTunePro USA LLC’s own duties as a developer, seller, distributor, or service provider; or
- waive government enforcement, product-liability law, gross-negligence rules, or other non-waivable rights.
