End User License Agreement and Terms of Service
Last updated October 18, 2026
Effective date: August 8, 2026
This agreement is between MotoTunePro USA LLC (“MotoTunePro,” “we,” “us,” or “our”) and the person or entity that downloads, installs, accesses, or uses MotoTunePro (“you”). It governs the applications, account and cloud services, MotoTune Intelligence, websites, documentation, and updates.
By affirmatively accepting this agreement, creating an account, or using the software after it is presented, you agree to it. If you do not agree, do not use MotoTunePro. You must be at least 18 and legally competent and authorized to perform the motorcycle work you undertake.
1. License and accounts
Subject to this agreement, MotoTunePro grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use the software in object-code form on devices you own or control for lawful personal use or your own internal business operations involving motorcycles you own or are expressly authorized to service. No ownership transfers to you.
You are responsible for accurate account information, credential and device security, activity under your account, and promptly reporting suspected unauthorized use. You may not share credentials, App Check tokens, license keys, or entitlements or attempt to obtain unauthorized owner, tester, or paid access. The Privacy Policy is incorporated here.
2. Billing status
MotoTunePro does not currently accept production subscription payments through the Android app. If a paid subscription is introduced, its price, billing period, renewal, included features, cancellation, refund, and restoration terms will be shown before purchase and will also be governed by applicable Google Play terms. Deleting an account will not automatically cancel marketplace billing if billing is later enabled.
3. Acceptable use
You may not:
- copy, sell, rent, redistribute, sublicense, or commercially host the software except as expressly permitted;
- reverse engineer or derive source code except where law prohibits that restriction;
- remove proprietary or safety notices or evade authentication, entitlement, compatibility, backup, checksum, voltage, confirmation, read-back, or recovery controls;
- upload malicious code, scrape, overload, probe, disrupt, or infringe another person’s rights;
- use the software while operating a motorcycle when it would distract you or violate law;
- facilitate reckless riding, public-road speed contests, or unlawful modifications; or
- use, market, or configure MotoTunePro as an emissions defeat device.
4. Vehicle work and assumption of risk
Diagnostics and calibration work can cause injury, death, fire, loss of control, engine or drivetrain damage, ECM failure, loss of a factory calibration, emissions violations, warranty disputes, and property damage. Motorcycles, prior modifications, wiring, adapters, firmware, calibrations, and operating conditions vary.
Work only on a motorcycle you own or are authorized to service. Use suitable tools, stable power, ventilation, and safe workshop practices. Secure the motorcycle, verify its identity and compatibility, consult service information and a qualified technician when appropriate, and safely inspect and test it before road use. Stop if operation, temperature, sound, communication, or data becomes abnormal. MotoTunePro is a tool, not a substitute for competent mechanical, tuning, safety, or legal judgment.
5. ECM reads, writes, backups, and recovery
A paired adapter, device node, CAN interface, or raw frame is not proof of a compatible ECM connection or write authority. Before every write, complete all controls presented by the software, including the protocol handshake and exact identity, a restorable vehicle-scoped backup, stable voltage and connection, size and compatibility checks, checksum validation, review of the exact change and recovery path, every rider confirmation, and post-write read-back, reconnection, and power-cycle verification. Do not interrupt power or communication during a write.
No autonomous writes. MotoTune Intelligence may propose changes and prefill a review flow, but it never authorizes a write. The rider or authorized technician must approve every write through the required confirmations. No AI output may bypass identity, backup, voltage, compatibility, checksum, read-back, or recovery gates.
6. Emissions compliance
You may use MotoTunePro only lawfully, including for diagnostics, maintenance, repair, restoration to a certified or original configuration, or a change with a documented lawful basis. Do not disable or defeat an emissions-control or required onboard-diagnostic function. “Off-road use only,” “race use only,” or a waiver does not automatically make a modification lawful. You are responsible for confirming compliance where a motorcycle is modified, registered, sold, or operated.
The Emissions and Regulatory Compliance Noticeis incorporated here. Nothing in this agreement excuses MotoTunePro from its own legal duties or limits government enforcement.
7. MotoTune Intelligence
AI output may be inaccurate, incomplete, inconsistent, or outdated and may misunderstand a motorcycle, log, map, or condition. It is advisory and is not a certification or guarantee of emissions compliance, mechanical safety, compatibility, performance, or legality. Independently review it. Never rely on AI as the sole basis for a write, road-safety decision, emergency decision, or legal conclusion.
8. Street Dyno and emergency features
Street Dyno produces estimates affected by GPS and motion error, vehicle assumptions, grade, wind, traffic, mass, gearing, tires, and rider inputs. It is not a certified chassis or engine dyno. Use it only where lawful and safe; never exceed a speed limit, create a hazard, or use the app while distracted.
Crash detection and emergency response are optional experimental aids, not a certified emergency device, medical device, or substitute for calling emergency services. They may miss or falsely identify a crash, fail to obtain location or connect a call, speak at the wrong time, or provide incomplete information. Device power, mounting, permissions, sensors, carrier service, location, and Android restrictions affect operation. Do not test by placing a non-emergency call to 911.
9. Hardware, services, and user content
Compatibility applies only to expressly identified features and configurations. Third-party hardware and services have their own terms. Referencing a trademark does not imply sponsorship or affiliation.
You retain rights in content you provide and represent that you have authority to use it. You grant MotoTunePro a limited worldwide non-exclusive license to host, copy, transmit, validate, transform, and process that content only as reasonably necessary to operate, secure, support, and legally comply for the services. This license ends when active content is deleted, subject to the Privacy Policy and required retention.
10. Ownership, availability, and termination
MotoTunePro and its licensors own the software, services, documentation, and branding. Open-source components remain governed by their licenses. We may provide required security, compatibility, feature, or legal updates and may change or discontinue a feature or provider subject to law. Do not update software during an ECM write.
You may stop using the software and delete your account. We may suspend or terminate access for material breach, fraud, abuse, danger, emissions or safety concerns, or legal requirements. Provisions that by nature should survive, including ownership, disclaimers, liability limits, indemnity, and dispute terms, survive termination.
11. Warranty disclaimer
To the maximum extent permitted by law, the software and services are provided “as is” and “as available.” MotoTunePro disclaims express, implied, and statutory warranties, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, safety, quiet enjoyment, and compatibility. MotoTunePro does not warrant that software, AI output, calibrations, emergency features, estimates, data, or hardware will be accurate, safe, legal, uninterrupted, error-free, compatible, or fit for a particular motorcycle. Non-waivable warranties and consumer rights remain unaffected.
12. Limitation of liability
To the maximum extent permitted by law, MotoTunePro USA LLC and its members, officers, employees, contractors, licensors, and agents will not be liable for indirect, incidental, special, exemplary, consequential, or punitive damages; lost profits, revenue, data, use, or goodwill; or substitute goods or services. Total aggregate liability will not exceed the greater of the amount you paid MotoTunePro during the twelve months before the event giving rise to the claim or US $100.
These limits do not apply where they cannot lawfully apply, including as applicable to gross negligence, willful misconduct, fraud, death or personal injury caused by negligence, statutory product liability, or non-waivable consumer rights.
13. Indemnification
To the extent permitted by law, you will defend, indemnify, and hold harmless MotoTunePro and its members, officers, employees, contractors, and agents from third-party claims arising from your unlawful use, unauthorized vehicle work, content, emissions tampering, reckless operation, or material breach. This does not apply to the extent a claim results from MotoTunePro’s negligence, willful misconduct, violation of law, or another matter that cannot lawfully be indemnified.
14. Law and disputes
Iowa law governs, excluding conflict-of-law rules, while mandatory consumer law in your residence may still apply. Before filing a claim, the parties will try in good faith for 30 days to resolve it after written notice unless immediate relief is reasonably necessary. Subject to non-waivable law, proceedings will be brought in state or federal courts located in Polk County, Iowa.
15. Google Play
Google is not a party to this agreement and has no responsibility for the software, support, warranties, claims, or intellectual-property disputes. Google Play terms also apply to downloads and transactions through Google Play. To the extent of a conflict, mandatory Google Play terms control for that distribution channel.
16. General terms and changes
This agreement, the Privacy Policy, the Emissions Notice, and terms shown at purchase are the entire agreement for the software and services. Unenforceable provisions will be enforced to the lawful extent and the remainder survives. Failure to enforce is not a waiver. You may not assign this agreement without written consent; MotoTunePro may assign it with a relevant business transaction subject to law.
We may update this agreement prospectively, post the revision here, and provide additional notice or renewed acceptance when required. If you do not agree to a revised agreement, stop using the software and services.
